aioeli

Conditions générales d’utilisation

Version du 14 octobre 2026

13. Droit applicable et for

Terms of use (English translation)

Version of 14 October 2026 — in case of doubt, the French version prevails.

1. Purpose and operator. These terms govern the use of aioeli, an online application for search firms and HR teams (mandates, candidates, AI CV analysis, careers page) at app.aioeli.com (the “Service”), operated by Guillaume Noel, Rue de la Pacotte 11, 2012 Auvernier, Switzerland, hello@aioeli.com (the “Operator”), personally until the company that will take over the Service is set up (section 12).

2. Customers and acceptance. The Service is for professionals. The person creating an account does so on behalf of the company or organisation named (the “Customer”) and confirms being authorised to bind it. These terms are accepted by ticking the box at sign-up; the date and the version are recorded.

3. Free plan — the only plan available. During the launch phase only the free plan is offered: one user, up to 10 mandates and 1,000 candidates, and AI CV analysis up to 20 CVs a day. The other AI agents (commercial proposals, adverts, candidate reports) are part of the paid plan, which is not sold yet. The free plan is provided free of charge; its features and limits may change, with at least 30 days’ notice for a significant reduction. No credit card is requested and nothing is charged without the Customer’s express agreement.

4. Access and account. Sign-in is passwordless, by a link and a code sent to the user’s email address. The Customer keeps that address under its control, tells the Operator at once about any unauthorised use, and is responsible for what is done from its account. Each account is personal: it belongs to one individual and is opened with that person’s own work email address. Shared or generic addresses (for example info@, hr@, jobs@) and temporary email addresses are not accepted, and access may not be shared between several people. An account can be signed in on at most one computer and one phone at the same time; signing in on another computer, or another phone, ends the previous session on that kind of device. If an account is clearly being shared, the Operator may suspend it after a warning that has gone unheeded.

5. Availability. The Service is in its launch phase and provided “as is”. The Operator strives for availability and security but does not guarantee uninterrupted or error-free operation; maintenance interruptions may occur. The Customer keeps the copies it needs of the documents it produces.

6. Artificial intelligence. AI output (profiles from CVs, categories, match with a mandate) consists of proposals that may contain errors; the Customer checks them before use. No decision about a candidate may rest solely on automated processing; the decision remains the Customer’s. The AI models are run by Infomaniak Network SA in its Swiss data centres; data sent to the AI is not used to train models.

7. Personal data. For the data of candidates, contacts and other people the Customer records, the Customer is the controller and the Operator a processor acting only to provide the Service and on the Customer’s instructions (art. 9 nFADP; art. 28 GDPR where applicable). The Customer ensures a legal basis and informs the people concerned, and answers their requests with the Service’s functions. Each Customer’s data is stored separately in the European Union. Sub-processors: Cloudflare (hosting, storage in the EU), Infomaniak Network SA (AI, Switzerland), Resend, Inc. (Service emails, EU region). The Operator does not sell the data or use it for any other purpose, and informs the Customer without undue delay of any data security breach affecting it. Users’ own data is handled as described in the privacy notice.

8. Acceptable use. The Customer uses the Service lawfully, in particular data protection and non-discrimination in hiring, and does not store unlawful content, infringe third-party rights, try to access other Customers’ data, disrupt the Service, scrape it by automated means, or circumvent the free plan’s limits.

9. Intellectual property. The software, the aioeli brand and the Service’s content belong to the Operator; the Customer receives a non-exclusive, non-transferable right of use for the life of its account. The Customer’s data and documents remain its property; the Operator may process them only to provide the Service.

10. Liability. To the extent permitted by law, the Operator’s liability is excluded for slight negligence, indirect damage (loss of profit, loss of data, reputation) and the consequences of using AI proposals. Liability for intent or gross negligence is not limited (art. 100 Swiss Code of Obligations). The Customer is responsible for the data it records and its use of the Service.

11. Term, termination and deletion. These terms apply from account creation for an indefinite period. The Customer may stop using the Service and ask for its account to be closed at any time by email to hello@aioeli.com; its data is then deleted within 30 days, after it could export it if it wishes. The Operator may suspend or close an account for a serious breach of these terms, or end the free plan with 30 days’ notice, during which the Customer may export its data.

12. Transfer to the company; changes. The Operator plans to transfer the Service, accounts and data to a company being set up, which will take over the rights and obligations under these terms; the Customer will be told in advance by email. The paid plan will be offered by that company under its own terms, which the Customer must accept expressly to subscribe. These terms may change; the Customer is told about any significant change at least 30 days before it applies, by email or in the Service, and may close its account before that date if it does not agree.

13. Governing law and jurisdiction. Swiss law applies, excluding conflict-of-law rules. Exclusive place of jurisdiction: Neuchâtel, subject to mandatory places of jurisdiction.

Nutzungsbedingungen (deutsche Übersetzung)

Fassung vom 14. Oktober 2026 — im Zweifel gilt die französische Fassung.
